Article 1: Definition
MADE IN PIGALLE: this term designates LES PARISIANS SAS. which is registered with a capital of € 20,000 and an intra-community VAT number: FR 0082 9445832, registered in the PARIS Chamber of Commerce under the number 829 445 832 and whose head office is located at 100, rue Blanche, 75009 – PARIS.
Site: this term designates the Made in Pigalle online sales website www.made-in-pigalle.com on which the Products are presented and sold to the Customer.
Product (s): this term designates the perfumery, cosmetics and accessories marketed by MADE IN PIGALLE and offered for sale on the Site.
Customer: this term designates the Internet user, a natural and non-professional person, who would be required to browse and / or order one or more retail product (s) for personal use on the site.
Party (ies): this term alternately or collectively designates MADE IN PIGALLE and / or the Client.
Order: this term designates the sales contract concluded between MADE IN PIGALLE and the Customer.
General Conditions of Sale: this term designates these General Conditions of Sale of Products on the Site.
Article 2: Subject
The purpose of these General Conditions of Sale is to define the terms and conditions under which MADE IN PIGALLE offers the marketing of Products on its Site to Customers, as well as the rights and obligations of the Parties arising from the online sale of these Products on the Site.
The Customer acknowledges having read and expressly accepted the General Conditions of Sale in force on the day of the Order, before placing his Order on the Site. This acceptance is in no way conditional on a handwritten signature on the part of the Client. These General Terms and Conditions of Sale are made available to Customers on the Site and can also be communicated to them upon request by email or post.
It is specified that the Customer can save or print these General Conditions of Sale provided, however, not to modify them. MADE IN PIGALLE reserves the right to update the General Conditions of Sale at any time. In case of modification of the General Conditions of Sale, those in force on the date of the Order will apply.
The General Conditions of Sale apply to any online sale made on the Site to the exclusion of any other document, and in particular the conditions applicable to sales in stores or through other distribution and marketing channels.
The resale or distribution of MADE IN PIGALLE Products purchased on the Site is strictly prohibited.
Article 3: Products
MADE IN PIGALLE offers for sale, within the limits of available stocks, the Products appearing only on the Site, on the day of consultation thereof by the Customer. MADE IN PIGALLE reserves the right to withdraw Products from online sale at any time without prior notice.
All product offers offered on the Site are limited to Orders placed for delivery in mainland France (including Corsica), Monaco, Andorra, Germany, Belgium, Luxembourg, Netherlands, Austria, Spain, Great – Britain, Italy, Estonia, Hungary, Latvia, Lithuania, Poland, Czech Republic, Slovakia, Slovenia, Sweden, Ireland, Denmark, Portugal, Finland, Bulgaria, Romania, Turkey, Switzerland.
MADE IN PIGALLE tries to best meet the requirements of article L 111-1 of the Consumer Code. The Customer can thus prior to his Order, acknowledge, on the Site, of the essential characteristics of the Product (s) that he wishes to order. However, the photos illustrating the Products sold on the Site do not enter into the contractual field and are only indicative.
Purchase offers including promotional offers are valid as long as they are advertised on the Site. Any promotional offer not coming from the Site (e.g not created by the MADE IN PIGALLE) cannot be validly opposed to MADE IN PIGALLE.
Article 4: PRICING
The current rate is the one indicated on the Site. The prices are expressed in euros and are understood to include all taxes, including the VAT applicable in France on the day of the Order. For countries outside the European Community, sales will be made without tax.
The prices do not include the shipping costs of the Products, which will be invoiced in addition and which will be indicated before the recording of the Order by the Customer.
MADE IN PIGALLE reserves the right to modify its prices at any time, it being understood that the Products ordered are invoiced at the price in force when the Order is registered.
Article 5: Order
The Products ordered by the Customer are intended for personal use thereof, without any direct relation to his professional activity.
To buy the Products, the Customer must log on to the Site and enter their e-mail address and password or create an account where they must enter their civility, last name, first name, address, e-mail address. mail and password.
The validation of any Order implies acceptance without restriction or reservation to these General Conditions of Sale.
The Customer’s Order will only be definitively validated after having chosen its delivery method, its payment method, and after having clicked on the “Order” button, it being understood that before clicking, he can check the details of his Order and its total price, modify or cancel it if necessary.
The Customer accepts that the validation of the Order takes the place of an agreement between the Parties. The validation of the payment by the Customer and an email confirming receipt of the Order by MADE IN PIGALLE will constitute proof of the acceptance of said Order and its final validation. The data recorded by MADE IN PIGALLE and the payment provider constitute proof of the nature, content and date of the Order.
Consequently, as soon as the Order is definitively validated, the Customer may no longer cancel or modify his Order, subject to the provisions of article 10 of these General Conditions of Sale. Payment will then be triggered upon validation of the Order.
In the event of unavailability after placing the Order, the Customer will be informed as soon as possible by e-mail. The Order will be canceled, payment will be credited back to the Customer, and MADE IN PIGALLE will notify it as soon as the product is available again. MADE IN PIGALLE is not responsible for any stock shortage or unavailability of the Products.
MADE IN PIGALLE reserves the right to cancel any Order from a Customer with whom there is a previous dispute or for any other legitimate reason having regard in particular to the abnormal nature of the Order, in particular in the event of an Order for quantities and / or unusual amounts for an end consumer.
Orders placed for delivery outside of France may cause different processing times, especially for deliveries of Orders excluding VAT.
Article 6: Payment
All orders are payable in euros.
The Order payment is made online on the Site by any means of payments available on the website at the purchase date (Visa, Carte Bleue, American Express, Mastercard). Payment is made via a secure server. This implies that no banking information concerning the Customer passes through the Site, which ensures a complete secure payment.
The full amount of the Order will be debited from the bank account from the day of the Order.
In the event of refusal of authorization to pay by bank card on the part of officially accredited and usual Internet organizations or in the event of non-payment or in the event of non-payment of all or part of a previous Order, MADE IN PIGALLE reserves the right to suspend any order management and any delivery.
In accordance with the Data Protection Act of January 6, 1978, the Customer has, at any time, a right of access, rectification and opposition to all of their personal data.
Article 7: Delivery
The Products ordered by the Customer in accordance with these General Conditions of Sale will be delivered to the address indicated by the Customer as the delivery address when ordering.
The delivery period begins to run as soon as the Order confirmation email is sent.
In accordance with current law, MADE IN PIGALLE undertakes to execute the Order within a maximum of thirty days from the date of validation of the Order, subject to availability and full payment of the price. In the absence of delivery at the end of this period, the Customer may cancel his Order and obtain a refund for his Order.
Article 8: Retention of title
The Products remain the property of MADE IN PIGALLE until full payment of the Order price. No dispute relating to the delivery in itself is possible if the package appears to have been delivered, the computer system of the carrier or the signing of the receipt confirming.
Article 9: Receipt of the Order – Complaints – Information
Upon receipt of the package, the Customer is required to check the conformity and condition of the packaging of the Products and to report any apparent defects. In the event of deterioration or partial loss of the Product, the Customer must imperatively formulate reservations which must be entered on the delivery receipt presented by the carrier and then communicate them by email, post or telephone to the attention of MADE IN PIGALLE.
For any information, complaint, question relating to the Products and their use or to the conditions of sale by mail, Customers must contact the MADE IN PIGALLE Customer Service by email at MADE IN PIGALLE -bonjour@made-in-pigalle.com or by post or by telephone on +33 (0)7 54 44 03 73, recalling the Ordering number.
Article 10: Right of withdrawal
From the delivery of his order, and in accordance with the provisions of article L. 121-20 of the French Consumer Code, the Customer has a period of fourteen clear days to notify his willingness to notify his right of withdrawal .
The Customer will have a period of fourteen days to return to the same address, at his expense and in their original packaging, the products ordered and unopened. It is important to the Customer to take care of the packaging of the returned products, the responsibility for transport falling to him.
Failing to return the Order within the time limit, the Order will be deemed final and no refund will be made, with the exception of the cases provided for in these General Conditions of Sale.
MADE IN PIGALLE undertakes to reimburse the Customer for the amount of the Order corresponding to the products returned subject to compliance with the conditions mentioned above. The refund will be made according to the payment method used by the Customer within 15 days of receipt of the returned products.
Article 11: Legal warranty and return of articles
The Customer benefits from the legal guarantee of conformity and the guarantee of hidden defects provided for in articles 1641 and following of the Civil Code. MADE IN PIGALLE undertakes, in the event of non-compliance of the Products with respect to the Order or delivery of a Product revealing a hidden defect, after receipt of the returned Product, or to exchange the Product with the Customer for a quality Product and of equivalent price depending on the availability of the stock, or to reimburse it by retrocession on the bank card used for the purchase corresponding to the price of the Product within a maximum period of 15 days.
Article 12: Liability
MADE IN PIGALLE is only bound by an obligation of means. It is up to the Customer to judge the appropriateness and suitability for their needs of the items they order. MADE IN PIGALLE cannot be held responsible for any use of the Products that is not in accordance with their destination.
The delivery being ensured by a third party service provider, MADE IN PIGALLE declines any responsibility in the event of too long delivery delay due to the postal services, as well as in the event of loss of the Products ordered or strike of the postal services. The Customer assumes the risks concerning the products delivered from the moment he takes possession of them during delivery.
The responsibility of MADE IN PIGALLE can only be retained in the event of proven fault exclusively attributable to it.
MADE IN PIGALLE reserves the right to suspend the operation of the Site, and does not guarantee that the Site is available continuously, without temporary interruption, without suspension and without error.
Article 13: Force majeure
The responsibility of MADE IN PIGALLE cannot be engaged for the total or partial non-execution of its obligations, if this non-execution is due to the fortuitous event or the occurrence of an element constituting force majeure. These events constitute a cause for suspension and / or termination of MADE IN PIGALLE’s obligations towards the Client, without compensation for the benefit of the Client.
Article 14: Intellectual property
In accordance with the laws and conventions governing intellectual property or other similar rights, this Site and all the elements, brands, drawings, models, photographs, texts, illustrations, logos, sequences animated or not, sound or not, graphics etc. found on this Site and their compilation are the exclusive property of LES PARISIANS or its subsidiaries, the latter granting no license or any right other than that of consulting the Site.
The reproduction, or the use of all or part of these elements is only authorized for the exclusive purposes of information for personal and private use, any reproduction and any use of copies made for other purposes is expressly prohibited. Neither all or part of the Site, nor its content, nor the brands may be used, reproduced, duplicated, copied, sold, resold, made accessible, modified or exploited in any other way, in whole or in part, for any purpose whatsoever. is. Any other use constitutes forgery.
Article 15: Applicable law – Litigation
These General Conditions of Sale and the contractual relations between MADE IN PIGALLE and the Customer are governed by French law.
In the event of a dispute between MADE IN PIGALLE and the Client, an amicable arrangement will be sought by the Parties, prior to any referral to a court.
Any dispute arising from the application or interpretation of the General Conditions of Sale falls, in the absence of an amicable arrangement as stated above, within the jurisdiction of the court of the jurisdiction of the Court of Appeal of Paris.
Any Order from a Customer carries with it the express and irrevocable renunciation of any action of any kind whatsoever which does not fall under the exclusive jurisdiction of French law.
